TERMS AND CONDITIONS

HOTH EXHIBITION, sometimes referred to as HOTH, is the commercial name of the company HOTH EXHIBITION SRL, a Romanian legal entity with its registered office in Bucharest, Str. Argentina, no. 25, registered with the Trade Register under number J40/15037/2023, VAT number 48629499.

Seller - HOTH EXHIBITION.

Buyer - an individual or legal entity, or any other legal entity that creates an account on the website and places an order.

Client - an individual or legal entity that has access to the content of the website.

Account - the section of the website consisting of an email address and a password that allows the Buyer to place an Order and contains information about the Buyer and their history on the website.

Content - all the information on the website, data related to the Seller, or any other information sent by the Seller to Buyers via email, SMS, or phone.

Favorites - a section in the Account that allows the Buyer to create lists of preferred products, which can later be added to the shopping cart.

Website - the domain www.hothexhibition.com and its subdomains.

Order - an electronic document through which the Buyer communicates their intention to purchase goods and services from the website to the Seller.

Contract - represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

CONTRACTUAL CLAUSES

By placing an order on the website, the Buyer agrees to the method of communication (by phone or email) through which the Seller conducts its commercial activities. The notification received by the Client after registering the Order does not constitute the acceptance of the Order; it serves only as information. For justified reasons, the Seller reserves the right to modify the quantity of goods in the Order, with prior notification to the Buyer via the email address or phone provided by the Buyer at the time of placing the order, and will refund the amount paid if necessary. The contract between the Seller and the Buyer will be considered concluded when the Seller communicates to the Buyer, via email, phone, or SMS, the notification of the shipment of the Order.

ONLINE SALES POLICY  

Any Client is allowed access to the content of the website, but for objective and justified reasons, the Seller reserves the right to restrict the Client's access to place an Order if they believe it may harm them in any way. All prices displayed on the website are expressed in Romanian Lei and include 0% VAT. In the case of online payments, the Seller is not and cannot be held responsible for any additional costs incurred by the Buyer, including but not limited to fees imposed by the issuing bank of their card; the Buyer is responsible for this action. The information used to describe the products does not represent an obligation on the part of the Seller; it is only used for presentation purposes.

INTELLECTUAL PROPERTY RIGHTS 

The Content, as defined in the preamble, including but not limited to logos, stylized representations, trademarks, static images, dynamic images, text, and/or multimedia content presented on the website, is the exclusive property of HOTH EXHIBITION, and all rights obtained directly or indirectly are reserved to them.

ORDER 

The Client can place orders on the website by adding a product to the shopping cart and completing the order by selecting one of the available payment methods. Adding a product to the shopping cart without finalizing the Order does not result in its registration. When a product is added to the shopping cart, it is available for purchase when it is in stock. By finalizing the Order, the Buyer consents that all the data provided by them, necessary for the purchasing process, are correct, complete, and true at the time of placing the Order.

 

By finalizing the Order, the Buyer consents that the Seller can contact them through any means agreed upon by the Seller, in any situation where contact is necessary.

In the event that a product ordered by the Buyer cannot be delivered by the Seller, the Seller will inform the Buyer and refund the value of the product to the Buyer's account if it has been pre-paid.

CONFIDENTIALITY

Information of any kind provided by the Buyer/Client to the Seller will remain the property of the Seller. No public statement, promotion, press release, or any other form of disclosure to third parties will be made by the Buyer/Client regarding the Order/Contract without the prior written consent of the Seller.

PROCESSING OF PERSONAL DATA

Through the privacy policy, HOTH EXHIBITION aims to transparently inform you about the collection and processing of personal data.

We consider ensuring the right to personal data protection as a fundamental commitment, and we will dedicate all necessary efforts to process your data in full compliance with Regulation (EU) 2016/679 ("General Data Protection Regulation" or "GDPR") and any other applicable legislation in Romania.

BILLING

The price, payment method, and payment term are set in each Order. The Seller will issue an invoice to the Buyer, and the Buyer is obligated to provide all the necessary data for the invoice in accordance with the applicable legislation. The Seller will transmit the invoice to the Buyer, either in electronic format to the email address provided by the Buyer or in physical format in the package containing the ordered products. The Client's payment card data will not be accessible to the Seller and will not be stored by the Seller or the payment processor integrated into the website; it will only be stored by the Transaction Authorization Institution or another entity authorized to provide card identification data storage services, about which the Client will be informed prior to entering the data.

DELIVERY

The delivery of goods is carried out by the Seller according to the option chosen by the Buyer, either by courier or easybox.

RESPONSIBILITY

The Seller cannot be held responsible for any damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations according to the Order, and for damages resulting from the use of the products after delivery, especially for their loss.

By creating and using the Account, the Client assumes responsibility for maintaining the confidentiality of the Account data (username and password) and managing Account access.

By creating or using the Account or placing Orders, the Client unequivocally and expressly accepts the Terms and Conditions of the Site in the latest updated version published on the Site.

Subsequently, after creating the Account, using the Content is equivalent to accepting the changes made to the Terms and Conditions of the Site.

MAJOR FORCE

Neither party shall be held responsible for the non-performance of its contractual obligations if such non-performance, on time and/or in accordance, in whole or in part, is due to a force majeure event. MAJOR FORCE is an unforeseeable event beyond the control of the parties and cannot be avoided.

If, within 15 (fifteen) days from the date of its occurrence, the respective event does not cease, each party shall have the right to notify the other party of the full termination of the Contract, without either of them being able to claim damages from the other.
